These conditions explain how purchases, payments, deliveries, warranties, returns and other transactions with FASE NUEVE work.

These Terms are the general e-commerce conditions. A product page, checkout, promotion or pre-order may add specific conditions; none may remove non-waivable consumer rights.

WHO IS THE SELLER

Purchases made through this site are entered into with the natural person or legal entity that commercially operates FASE NUEVE and is identified below. This information must remain accurate, complete, visible and current before online sales are enabled.

USE OF THE SITE

The site may be used to review products, compare references, request information, create a purchase selection and access the available support channels. Users must use it lawfully, provide truthful information when a transaction requires it, and refrain from attempting to alter prices, availability, security or operation.

Where guest checkout is available, creating an F9 Account will be optional. Browsing, saving a wishlist or adding an item to a cart does not by itself create a sale or reserve inventory.

Consumer rights: nothing in these Terms limits non-waivable rights granted by Colombian law. A more favorable specific condition or a mandatory legal rule will prevail where applicable.

Commercial acceptance and marketing

When online purchasing is enabled, the confirmation action must identify the version of these Terms accepted and preserve evidence of that acceptance linked to the session or order. Any permission to receive advertising will remain separate, optional and unchecked by default.

PRODUCTS

The specifications, variants, features, photographs, price and availability status that apply are those published for each reference at the time of purchase, together with the specific conditions shown on its product page.

  • The selected variant —such as color, memory, storage or configuration— must be identified before confirmation.
  • Images must reasonably represent the product; minor color differences caused by a screen do not authorize substitution of a reference or essential feature.
  • Accessories, services or elements not expressly listed as included are not part of the purchase.
  • FASE NUEVE will not materially and unilaterally change a confirmed product. Any alternative requires prior information and the consumer's agreement.

Product-specific warranty, compatibility and use requirements may also appear on the product page and supplement these Terms.

AVAILABILITY AND PRICES

Prices are stated in Colombian pesos (COP) unless another currency is clearly indicated. Before confirmation, the checkout will disclose product prices, applicable discounts, shipping, taxes and any additional charge. No surprise charge will be added after confirmation.

Available

The reference appears eligible for purchase, subject to final order validation.

By order

Sourcing requires confirmation of timing, price and conditions before payment.

Pre-order

The sale is also governed by specific launch, delivery and cancellation conditions.

Sold out

The reference is not available for immediate purchase.

Publishing a product does not guarantee inventory until the system validates the reference, variant and availability connected with the order. This rule does not authorize fictitious stock. If a paid product becomes unavailable, FASE NUEVE will promptly communicate the legally available alternatives, including a refund where applicable.

Total before confirmation: an unknown amount must not be shown as COP $0. If shipping or another component is still undetermined, the purchase cannot be confirmed as having a final total.

ORDERS

The process may include product selection, cart review, contact and delivery information, selection of an available shipping option, presentation of the total and confirmation. Once the request is submitted, the system may create a reference to identify it and communicate its status.

ORDER CREATED ≠ ORDER PAID. Creating a reference or sending an acknowledgement does not mean payment has been approved. An order is paid only when the payment provider and FASE NUEVE confirm that status.

Before accepting an order, FASE NUEVE may validate the product, variant, price, discount, taxes, shipping, availability and consistency of the operation. If information must be corrected, the consumer will be informed before a material change is made.

Payment and preparation statuses will be communicated through the channels disclosed at checkout. Where tracking is available, the order reference and a secure access method will allow the consumer to review progress.

PAYMENTS

The payment methods actually available will be shown during checkout. They may be processed by authorized external providers under their security flows and the conditions disclosed before confirmation.

FASE NUEVE will not request or store a full card number, CVV or equivalent credentials directly in browser storage. Sensitive payment information will be captured by the payment gateway that is actually integrated.

A transaction may be approved, pending or not approved. A pending payment is not treated as paid and must not be repeated automatically. Where the status is uncertain, the consumer may verify it before attempting another transaction.

SHIPPING

Coverage, method, cost, carrier where applicable, conditions and the estimated date or range will be disclosed before purchase confirmation whenever the transaction requires them. Available logistics information is supplemented by the Shipping Policy.

The consumer must provide an accurate address and contact information. FASE NUEVE will communicate relevant updates and, where appropriate, may split one order into more than one package without changing the accepted total, clearly identifying each shipment.

The delivery period accepted during purchase is the primary reference. If no period was agreed, the current statutory period will apply. Where unavailability or delay activates a legal remedy, the consumer may exercise the applicable options without improper deductions from a refund.

PRE-ORDERS

Priority list

Joining a priority list expresses interest and allows the consumer to receive information. It is not a purchase, does not involve payment and does not reserve inventory.

Active pre-order

A pre-order exists only when FASE NUEVE publishes specific commercial conditions for a reference: price or pricing method, deposit or payment, quantity limits where applicable, estimated date or range, delivery, cancellation and any manufacturer changes that have been disclosed.

Specific pre-order conditions supplement these Terms and will appear in FASE NUEVE Pre-orders and on the relevant product page. The “pre-order” label will not be used to disguise ordinary lack of stock.

WARRANTY

Products are covered by the applicable statutory warranty and, where available, an additional manufacturer or importer warranty. Each product page should provide the available specific information, including duration, coverage, lawful exclusions and the support channel.

Warranty addresses defects in quality, fitness or safety and is separate from a voluntary exchange, withdrawal right or payment reversal. An additional warranty cannot reduce minimum legal protection.

EXCHANGES, RETURNS AND WITHDRAWAL

These remedies serve different purposes and are handled according to their basis:

  • Commercial exchange: a voluntary benefit subject to published FASE NUEVE conditions, without reducing statutory rights.
  • Withdrawal right: a right that applies to certain distance sales. Where applicable, it may be exercised within the five (5) business days provided by law, subject to statutory exceptions.
  • Warranty: a remedy for defects or failures in quality, fitness or safety.
  • Payment reversal: the procedure for legally defined events involving electronic payments.

For a valid withdrawal, the product must be returned under the conditions required by law. Once the applicable requirements are met, the refund will not exceed the current statutory maximum of fifteen (15) calendar days, and the available refund options will be explained clearly.

No waiver: these Terms do not establish a blanket “no returns” rule and do not require consumers to waive withdrawal, warranty or any other applicable right.

PAYMENT REVERSAL

Where an e-commerce purchase was paid through an electronic instrument, the consumer may request reversal in the events defined by law, including fraud, an unauthorized transaction, a product not received, a product different from the one ordered, or a defective product.

The request requires action within the statutory period, a complaint to the provider and notice to the issuer of the payment instrument with the necessary information. As a general rule, these steps must be taken within five (5) business days after learning of the event or receiving the product that gives rise to the request.

FASE NUEVE will provide a channel to receive the complaint and will coordinate with payment participants under the applicable procedure. Reversal does not replace warranty or withdrawal where the facts belong to another remedy.

CANCELLATIONS

Before payment, a user may abandon the selection without a purchase being formed. After an order is created or paid, the availability and consequences of cancellation depend on its status, the specific conditions disclosed and the statutory rights that apply.

FASE NUEVE will not arbitrarily cancel a confirmed order. If an objective cause arises —such as genuine sourcing impossibility, an obvious error that must be corrected before contracting, a legitimate security alert or delivery impossibility— the consumer will be informed, the alternatives will be explained, and any applicable refund will be made without improper deductions.

Pre-orders and by-order products may have specific cancellation terms visible before confirmation and may not remove non-waivable rights.

PROMOTIONS

Each promotion or offer will clearly state the participating reference or category, the benefit, validity period, access conditions, lawful restrictions, consumer costs and availability where applicable.

The specific published conditions of a promotion prevail over a general description only for that campaign and only where they do not reduce statutory rights. Images, discounts and quantity limits must allow the consumer to understand what is received and on what terms.

A promotion does not apply retroactively to orders confirmed outside its validity period unless its own terms provide a more favorable result.

F9 ACCOUNT

F9 Account will be an optional self-service tool. When real authentication exists, it may bring together orders, tracking, favorites, addresses, warranties and support requests. An account will not be required where checkout allows a guest purchase.

Users will be responsible for keeping credentials confidential and reporting unauthorized use once the access system is active. FASE NUEVE will apply reasonable controls and will not present features as available before they actually are.

INTELLECTUAL PROPERTY

The FASE NUEVE brand, site design, original text, photographs, illustrations, interfaces, logos and other protectable materials belong to their respective owners. Manufacturer marks and materials are used to identify products under applicable permissions, licenses or legally allowed uses.

Accessing the site does not transfer intellectual property rights. Content may not be copied, commercially exploited, altered, scraped at scale or reused without authorization, except as permitted by law.

LIABILITY

FASE NUEVE remains responsible for its supplier obligations under applicable law. Nothing on this page is a blanket exclusion of responsibility for quality, fitness, safety, information, delivery, warranty or personal-data protection.

The user is responsible for reviewing published compatibility and requirements, using products according to their instructions and providing accurate transaction information. This does not remove any responsibility that legally belongs to FASE NUEVE, the producer, importer, carrier or payment provider.

External events or force majeure will be handled with timely information and the applicable alternatives. Third-party links are complementary routes; their presence does not remove FASE NUEVE's own obligations or authorize unverified security badges.

PERSONAL DATA

Personal-data processing is governed by the Personal Data Processing Policy. These Terms do not replace or reproduce that policy.

FASE NUEVE will request only the information necessary for the disclosed purpose, apply proportionate security measures and separate information required to perform a purchase from any optional marketing consent.

Sensitive payment information must be handled by the gateway or authorized transaction participants; full card details and CVV will not be stored in browser local storage.

CONSUMER SUPPORT

Questions, requests, complaints and claims about a purchase may be submitted through the channels identified on this page and the FASE NUEVE Support Center. To review a transaction, the order number and only the information strictly necessary to validate it may be requested.

The link to Colombia's consumer-protection authority is clearly visible and does not limit the consumer's right to contact the SIC or use any mechanism available under law.

CHANGES TO THESE TERMS

FASE NUEVE may update these Terms to reflect legal, operational or commercial changes. The current version will display a genuine update date and be available before new purchases are confirmed.

An update will not retroactively change the essential conditions of an already confirmed order or reduce acquired rights. Each transaction is governed by the accepted version, its disclosed specific conditions and the applicable law.

When online sales are enabled, the system will preserve reasonable evidence of acceptance, including the version, date and link to the session or order, without combining it with optional advertising consent.
